Agent for owner, Gallery Homes of Deland, is requesting the removal of two (2) healthy historic live oak trees from the property located at 478 River Dr.
The purpose of the request is to accommodate construction of a future single-family home, pool, and pool deck. Please find the attached site plan.
According to the DeBary Land Development Code, Section 5-94, Historic and Specimen Trees; ~historic trees shall only be removed or relocated upon approval of a permit granted by the City Council. ~Live oak trees are defined as historic when the DBH (diameter at breast height) of a healthy tree is 30 inches or greater.
The existing site has not been previously impacted and, therefore, is required to undergo tree removal permitting review prior to construction. Upon review of the Applicant’s request, the subject trees were identified to be historic and necessitate Council approval for their removal.
Findings of Fact
Land Development Code, Section 5-94, states that historic trees shall only be removed or relocated upon approval of a permit granted by the City Council. Therefore, the City Council may consider Applicant’s request, which is as follows:
- Approve the removal of the 34” diameter at breast height (DBH) historic live oak; located north-center within the lot and encroaching upon the proposed single-family home. And, approve the removal of the 37” DBH historic live oak; located northwest within the lot and encroaching upon the pool deck.
Approve the Applicant’s request for historic tree removal.
