The City has received a request from Mr. Tino Farjad, owner of 45 Alicante Road, to abandon an existing 20-foot drainage easement granted to the City in January 2005 as it traverses his property and diminishes the value of his parcel (refer to Book 5470, Pages 749 – 751 for the Drainage Easement document recorded on January 6, 2005).
Said drainage easement was acquired by the City in early 2005 as a result of the emergency installation of pump hoses and later dual 18-inch underground pipes that served as a hydraulic connection between Gem Lake and Half Moon Lake during pumping operations.
After the requested easement abandonment, the City does not have an immediate need to relocate the existing dual pipes. However, the property owner is willing to grant an alternate drainage easement to the City to run along the eastern limits of his property. The existing dual pipes would be abandoned in place and a new pipe system installed within the limits of the new drainage easement, when the need arises. Refer to the attached figures for a depiction of the parcel under discussion under existing and proposed conditions.
Request Council approval for the requested abandonment of the existing 20-foot drainage easement at 45 Alicante Road.
