Request:
To approve a road maintenance agreement between Traderscove Corporation/Henin Springview, LLC and The City of DeBary.

Goals/Objective:
The goal of the Fort Florida Road Maintenance Agreement (‘Agreement’) with Traderscove Corporation and Henin Springview, LLC (‘Henin’) is to facilitate the approval of the preliminary plat and construction plans for Riviera Bella East and Springview Unit 8 residential communities (‘Developments’). The need for the Agreement is to ensure Fort Florida Road conditions are maintained in a safe, clean, and adequate capacity during the period of hauling dirt from and to the two developments of Riviera Bella East and Springview.

Considerations:
Fort Florida Road is approximately 4.5 miles long and located in the southwestern quadrant of the city. The road intersects Highbanks Road to the north and US 17-92 on the east.

The developments of Riviera Bella East (293 single family homes) and Springview (195 single family homes) will require the exporting and importing of dirt from and to the sites. Much of this dirt will export from Springview and be transported to Riviera Bella East, using Ft. Florida Rd. (Please see haul route attached). Therefore, a road maintenance agreement will ensure that, during the period of mass grading, import and export of dirt for these two developments, that the heavy truck loads traveling Ft. Florida Road will not negatively impact the integrity of the road, which is currently showing signs of significant wear.

Due to the significant construction activity anticipated from Henin’s development, a Road Maintenance Agreement should be required to ensure the road condition is maintained.

Funding:
This agreement does not require any funding by the City.

Recommended Motion:

Approve the Fort Florida Maintenance Agreement requiring the developer of these to sites to maintain and/or repair any damage caused by dump truck traffic hauling dirt to and from the associated developments.
