Applicant, Interplan LLC, is requesting approval of a major amendment to the Business Planned Unit Development (BPUD) Crossings on Enterprise. The applicant is requesting the development agreement and associated site plan for the BPUD be amended to provide for the assisted living facility (ALF) use. The property is located approximately 0.1 miles west of Enterprise road, along and accessible by Signature Drive, south and west of Orange City municipal boundary, north and east of Glen Abbey.

Background Discussion
August 6th 2003, the City of DeBary City Council approved and adopted Ordinance #11-03, effectively changing the zoning designation of approximately 4.6 acres from R-4 Urban Single Family Residential to BPUD Business Planned Unit Development. The approved uses within the BPUD provided for a character much like an office park; including general offices financial institutions, personal service businesses, daycare centers, and medical or dental clinics where patients are not lodged overnight. The existing BPUD is part of a larger office park that spans the boundaries of DeBary and Orange City. To date, the office park's existing improvements include infrastructure such as storm ponds, landscaping, parking lots, drive isles and office buildings that are built on approximately half of the project site area.   On May 5th 2016 the applicant, Interplan LLC, submitted an application requesting a major amendment to the existing Crossings on Enterprise Business Planned Unit Development (BPUD). The PUD amendment would allow for the assisted living facility and for patients to be lodged overnight. Additional changes include those associated with the provisions for the Assisted Living Facility (ALF) such as an approved site plan and supportive infrastructure.   The applicant has submitted a conceptual plan consisting of one (1) assisted living building, approximately 61,000 sq. ft, at three stories tall (maximum height of 35') with up to 160 beds, one (1) 6,656 sq. ft. office building, two (2) landscaped resident parks, a central storm pond feature, walking trails, benches, and emergency facility infrastructure.   

Matrix of Compatibility. Land uses within the compatibility matrix relate to one another by providing a visual reference to the character of the surrounding spaces, presently and in the future. The proposed development is compatible with the intended character and classification of space as, (1) the character of the existing BPUD is to provide for medically related uses, (2) it will buffer single family residential housing from more intense commercial facilities within Orange City and the Water Treatment Facility, and (3) the proposed development shall work in conjunction with the existing medical developments and not adversely impact the residential dwellings to the west.

Findings of Fact
The proposed BPUD amendment is consistent with the Comprehensive Plan Policy 5.403 which allows for a commercial, office and residential uses. The proposed BPUD amendment is consistent with the Land Development Code Sec 3-108 PUD.
The Development Review Committee recommended approval of the proposed BPUD Amendment on August 30 contingent upon the applicant successfully addressing all staff comments.
