SUMMARY/HIGHLIGHTS Second Reading. The property owners and applicant, Bolder Properties, LLC are requesting an amendment to Business Planned Unit Development (BPUD) Riverside at DeBary. The subject property is approximately 5.28 acres and located on the east side of US HWY 17-92 at 901 & 903 South Charles Richard Beall Blvd and Parcel ID #16-19-30-01-00-0040.
REQUEST The applicant has requested modification to the development agreement for the Riverside BPUD to provide for limited Light Industrial uses; including automobile, truck –trailer, motorcycle, boat, mobile home, manufactured dwelling, recreational vehicle, bicycle manufacturers, and also machinery and machine shops.

BACKGROUND DISCUSSION The subject property’s use was impacted by the 2008 recession. To date, the constructed buildings have remained vacant and surrounding businesses have revolved in ownership. Recently, Bolder Properties LLC has identified a stronger market demand for the proposed uses and has requested an amendment to the BPUD. The future land use of the subject property is SEMUA. As an existing BPUD, the character of the proposed amendment is consistent with the FLU designation and the Land Development Code.
FINDINGS OF FACT The City of DeBary Department of Growth Management finds the requested amendment sufficient of fulfilling those items specified in LDC Sec. 3-108 (c) PUD Planned Unit Development the criteria for permitted principal uses and structures as;
- “Permitted principal uses and structures shall be agreed upon by the City Council and are dependent upon which sub-classification is requested.”The applicant’s current principal uses and structures have been previously approved by City Council.“Other uses and structures of a similar nature to those listed, after determination by the City Council at the time of master development plan approval that such uses and structures are compatible with the PUD development and the surrounding area.”The proposed amendment is consistent with existing uses of the surrounding area.
RECOMMENDED MOTION: Approval of the second reading of Ordinance 06-16 to amend the BPUD located at 901 & 903 South Charles Richard Beall Blvd. and associated with Parcel ID #16-19-30-01-00-0040. Pursuant to Section 1-9(3), LDC the City Council may impose additional reasonable conditions for the establishment and operation of the use. |
