The City is proposing to amend the land development code to incorporate a residential lighting ordinance. The ordinance would prohibit lighting located on privately owned property which results in beams, rays, reflections or diffusions of light from spilling out, over or onto adjacent and, or surrounding residential properties.

Background Discussion
Currently the City does not have any specific code criteria strictly prohibiting the nuisance of light pollution that may be created by and within residential communities. While there have been complaints in the past of lighting intrusion from neighboring residential dwellings, the City has not been in a position to enforce or abate such complaints. Therefore, staff is proposing a lighting ordinance that would add language to Section 30-36-Declaration of nuisance, of the Land Development Code, prohibiting light pollution into adjacent and surrounding residential dwelling and lots.Please see the attached Ordinance #05-15 for the proposed language. However, to avoid unintended consequences, certain exceptions have been added to the proposed ordinance language such as the allowance of streetlights, temporary construction lighting as well as emergency  and holiday lights.

Recommended Motion  
Approve Ordinance # 05-15 amending the Land Development Code, Sec 30-36 - Declaration of nuisance.
