Summary/Highlights
The applicant, Conrad Yelvington Distributors, Inc. is requesting final site plan approval for an aggregate distribution facility, located at the western terminus of Springview Commerce Drive, adjacent to and east of the rail road tracks. Please see the attached site plan.

Background Discussion
The subject property is approximately 15 acres and having parcel ID number 04-19-30-16-00-000I. The applicant is expanding their operation north to provide additional storage for aggregate material. The proposed project will utilize both the rail cars on the adjacent tracks as well as dump trucks to transport material on surface roads to and from the site. Please see the attached site plan.

The subject property is located within the City’s industrial district. Negative impacts to adjacent properties as a result of the proposed use are anticipated to be limited. However, due to the anticipated increase in heavy equipment, a developer’s agreement was drafted to ensure that the applicant covers the cost of any unforeseen immediate and sever degradation to Springview Commerce Drive. Please see the attached Developer’s Agreement.

The subject property currently contains an access easement conveyed to the City of DeBary permitting access to the city owned property west of the site, known as the “borrow pit” which is utilized for the City's stormwater management system. The proposed final site plan project conflicts with the current access agreement. Therefore, a realignment of the easement is necessary. This is done by conveying a new easement to the city that runs north around the project site area. Please see the attached easement conveyance documents to be executed and recorded concurrent with the approval of the final site plan.


Development Review Committee
The City of DeBary Development Review Committed (DRC) reviewed and recommended approval of the final site plan for the Yelvington Distributors project on August 18, 2015 subject to the following conditions.

  • Convey a new access easement to allow continued access by the City of DeBary from Springview Commerce Drive to the “borrow pit”, parcel ID number: 05-19-30-00-00-0010.
  • The aggregate in the trucks must be covered when exiting the site onto Springview Commerce Drive.
  • The property owner is responsible for any damage to the road beyond normal wear and tear due to heavy-loads and volume of trucks.
  • The property owner is responsible for cleaning up/removing any debris or aggregate that falls off the trucks onto Springview Commerce Drive and/or any other city roads.
Land Development Code Regulation
The Final Site Plan application meets the provisions of the Land Development Code, which specifically includes:

  • Chapter 4, Article II, Division 3, Section 4-62. Conceptual or Final Site Plan Review
  • Chapter 4, Article II, Division 4, Design and Construction Standards of Improvements
  • Chapter 5, Article I. Landscaping and Buffer Standards
Findings of Fact
The City of DeBary Development Review Committee has reviewed and approved the Yelvington Distributors Inc., final site plan. Therefore, pursuant to Section 4-23 (c) of the City’s LDC, DRC recommends approval of the Development Order for the final site plan with the following conditions.

  • Convey new access easement to allow continued access by the City of DeBary from Springview Commerce Drive to the “borrow pit” parcel number: 05-19-30-00-00-0010.
  • The aggregate in the trucks must be covered when exiting the site onto Springview Drive.
  • The property owner is responsible for any damage to the road beyond normal wear and tear due to heavy-loads and volume of trucks.
  • The property owner is responsible for cleaning up/removing any debris or aggregate that falls off the trucks onto Springview Drive and/or any other city roads.

Recommended Motion
Approve the Final Site Plan for Case # 15-01-FSP-Yelvington for an aggregate distribution facility at the western terminus of Springview Commerce Drive, parcel ID number: 04-19-30-16-00-000I, with the recommended conditions of approval by the DRC. Further, authorize the relocation of the existing access easement in favor of the city over the subject property and execution of the proposed amendment to access easement providing for such easement relocation, and approve and authorize the execution of the road maintenance developer’s agreement between the city and the developer.
