Summary/Highlights

Property owners abutting Ft. Florida, 15th Street and River Drive have requested the City form a Special Assessment District to construct a water line to provide potable water and fire service. Subsequently property owners abutting Ft. Florida Point Road expressed an interest in also being included in the project.

The Resolution of Intent provides notice to the public of the City's intention to impose an assessment against specific property for the purpose of constructing a water line.

Background Discussion

Resolution 15-02 gives notice of the City's intent to use the uniform method for the levy, collection, and enforcement of non-ad valorem assessments in accordance with § 197.3632, Florida Statutes, and to impose the Special Assessment upon the Ft. Florida Road, 15th Street and River Drive Parcels and the Fort Florida Point Road Parcels to recoup all costs and expenses associated with the Water Main Project. The cost of the project will be assessed per lot receiving benefit.
After adoption of the Resolution of Intent the summary of required events are:

  • City to send assessment package to tax collector, property appraiser and department of revenue postmarked by January 10, 2015 (or March 10, 2015 if agreed to by tax collector and property appraiser).
  • Publication for City’s second public hearing must occur at least 20 days prior to the second hearing and mailing of notice of the hearing to all affected property owners regarding Resolution of Adoption of Assessment Roll.
  • City to hold public hearing to adopt the second Resolution on adoption of assessment roll between January 1, 2015 and September 15, 2015.
  • City to certify non-ad valorem assessment roll to tax collector by September 15, 2015.
Florida Statutes specify that at the time the Resolution of Intent is considered the cost of the improvements and plans and specifications are not required. In order to provide as much information as possible the estimated project cost known to date is below. Volusia County agreed to pay a portion of the cost to upsize a portion of the pipe, however the exact amount is not yet known.

The final cost of the project will be available at the time the assessment roll is imposed and will be based upon the cost of the contract award and all cost incurred by the City.
