The applicant, John G Noonan, Bishop of the Diocese of Orlando, on behalf of  St. Ann's Catholic Church is requesting final site plan approval for a parking lot expansion, a new driveway access from US Hwy 17-92 and associated infrastructure for the existing church located at 26 Dogwood Trail on the west side of US Hwy 17-92. Please reference the attached site plan.

Background Discussion
The subject property is 15.33 acres. The church was originally built in 1971. In 1990 a special exception was approved by Volusia County to maintain and expand the existing church (please see Volusia county Special Exception File (S-90-089) attached).

Over the years, the church has experienced parking issues and has not had enough parking to meet demand. Currently the church has 236 existing parking spaces (226 standard, 10 handicap). The church is proposing an addition of 110 parking spaces for a total of 346 spaces (249 regular, 70 grass and 26 handicap).

The church is proposing to remove a large number of existing trees to create the new parking areas but is providing a landscape plan for replanting of replacement trees and landscape buffers (please see LA plans attached). The applicant is also requesting approval to remove specimen trees. The specimen trees will be replaced in accordance with Section 5-93 of the Land Development Code.

The subject property is located within the City’s Gateway Corridor District. Properties within the Gateway Corridor are required to provide a 20-foot landscaped buffer to include groundcovers, shrub material and Live Oak trees. The proposed landscape plan retains existing trees and provides additional landscaping to enhance the buffer and meet the requirements of the Gateway Corridor. Please see the attached landscape plans.

An environmental inspection of the site was performed on July 22, 2014 by Lostepeich and Associates, Inc. and no listed plant or animal species were observed in the undeveloped area proposed for expansion with parking and driveways.

The proposed access onto US Hwy 17-92 is under review by the Florida Department of Transportation (FDOT), who will issue a ROW use permit for the driveway upon approval of the site plan by the City.  

Development Review Committee
The City of DeBary Development Review Committed (DRC) reviewed the final site plan for the parking lot expansion for St. Ann's Catholic Church on June 3, 2014 and September 16, 2014. Several revised plans have subsequently been submitted and reviewed by DRC. A revised site plan dated November 6, 2014 was submitted by the applicant. DRC approved the final site plan subject to the following conditions.

1. A copy of the FDOT Right of Way Use Permit shall be provided to the City prior to commencement of construction.
2. Outstanding stormwater review comments shall be resolved.

Land Development Code Regulation                                                                                                                                          The Final Site Plan application meets the provisions of the Land Development Code, which specifically includes:
  • Chapter 4, Article II, Division 3, Section 4-62. Conceptual or Final Site Plan Review
  • Chapter 4, Article II, Division 4, Design and Construction Standards of Improvements
  • Chapter 5, Article I. Landscaping and Buffer Standards

Findings of Fact
The City of DeBary Development Review Committee has approved the St. Ann's Church parking lot expansion and new access final site plan.  Therefore, pursuant to Section 4-23 (c) of the City’s LDC, DRC recommends approval of the Development Order for the St. Ann's Church final site plan with the following conditions.

1. A copy of the FDOT Right of Way Use Permit shall be provided to the City prior to commencement of construction.
2. Outstanding stormwater review comments shall be resolved.
