City Council Workshop

During the April Workshop business owners requested the Council consider amending the current ordinance for Outside Service and Consumption of Alcohol.

The City Council visited this issue last in August of 2012 by adopting Ordinance 04-12 which amended Section 6-6 of the Code of Ordinances that provided in part “No outside alcohol service or consumption shall be permitted outside of a building of a vendor or distributor of alcoholic beverages within the city limits unless expressly permitted by the Land Development Code as a permitted or special exception use…”

In addition Ordinance 04-12 amended Section 3-102. B-4 General Commercial Classification to include as a special exception “restaurants with outside service of alcoholic beverages and entertainment. The restaurant must operate under a 4COPSRX license or shall meet similar limitations. Outside service shall be limited to the same hours of operation as interior service.”

Ordinance 04-14 expanded the areas in which outside service and consumption of alcohol were permitted to include all B-4 commercial zones by special exception. The ordinanance did not change the requirement that the business must possess a 4COPSRX license.

As a reminder the TOD regulations adopted by the Council allows both retuarants and bars to have outside seating and service subject to certain restrictions.

The Council directed staff to survey surrounding jurisdictions regulations on the Outdoor Service and Consumption of Alcohol, which is attached.
